General conditions of sale


The Digital Store edited by TWINSET France, accessible at www.twinset.com (hereinafter the "Digital Store"), allows the online purchase of clothes, shoes, leather goods and accessories of brands belonging to TWINSET S.p.A., of which TWINSET FRANCE is a subsidiary (hereinafter the "Products").


The present general conditions of sale (hereafter the "GCS") are intended to govern the contractual relationship between,

The company TWINSET FRANCE, a French simplified joint stock company, with a share capital of 250.000,00 euros, located 56 avenue Saint Philippe, 06 000 Nice, registered at the Nice Trade and Companies Register under the number 799808027, whose intracommunity VAT number is FR 83799808027 and which can be contacted by email (info@twinset.com), hereafter ("TWINSET FRANCE" or “we”),

Each of the consumer customers, in the sense of the preliminary title of French Consumer Code (hereafter the "Client" or the "Clients" or “you”), On the other hand,

Together "the Parties".



The GCS cover the purchase of Products by Clients on the Digital Store (hereinafter the "Order").

As the GCS are subject to change at any time, it is your responsibility to consult them regularly; the applicable GSC are those in effect on the day your place your Order.

No special conditions can, except with the express written acceptance of TWINSET FRANCE, prevail over the GCS. Any special condition opposed by the Client will be, in the absence of our express written acceptance, unenforceable and deemed unwritten, whatever the moment when it may have been brought to our knowledge.

The GCS are accessible via the hypertext link located at the bottom of each page of the Digital Store.

Any Order on the Digital Store is made after you have read and accepted without reservation the GCS and the General Terms of Use of the Digital Store, and after you have been informed of the Data Protection Policy.


1. Products


The Products displayed on the Digital Store contain a description enabling you to know their essential characteristics and their price.

This information is intended to inform you as fully as possible about the essential characteristics of the Products, without being exhaustive.

The pictures and visuals of the Products are provided for illustrative purposes: a slight variation in presentation may occur, without affecting the Product itself.


2. Orders


If you do not agree with the GCS, you will not be able to Order on the Digital Store.

To constitute your shopping cart, you can access the Product(s) of your choice, and enter the size and/or quantity desired.

You can then access your shopping cart by clicking on the "Go to your Cart" tab at the top left of the Digital Store page.

You will then arrive on the summary page of your Order, and find the list of the Products in your shopping cart, their essential characteristics, the price that refers to them, including any applicable shipping costs if any (and any taxes or duties) depending on the delivery mode chosen. See this page for information on shipping times.

By clicking on "Proceed to the payment", you will be asked to identify yourself if you already have a client account on the Digital Store, or to create a client account by filling out a form specifying certain mandatory fields so that TWINSET FRANCE can process your order. The client account allows you to retrieve your personal information without having to re-enter it, and to modify it if necessary.

You can also proceed as "Guest" to Order, without creating an account and just by filing his e-mail address, which still allows you to follow the shipment of your order, and, if applicable, possibly request the free return service.

The recap of your Order form contains a summary of the information on the Products ordered, the price that refers to them, the delivery options chosen and the means of payment that you can use to purchase the products. This Order form allows you to check these information and to correct them if necessary. Once all the information has been verified, you can proceed to the next step by clicking on "Payment".

Then, you can select the payment method from the options provided and check the box "I accept the General Conditions of Sale" and then click on "Payment". You have the possibility to check one last time your delivery method, your contact details and the chosen payment method before definitively confirming your Order and paying by clicking on "Complete the order and pay".

Once the Order is complete, TWINSET FRANCE will confirm it by sending an email containing the Order summary.

However, this email does not constitute an automatic acceptance of the Order. TWINSET FRANCE reserves the right to refuse orders from Clients with whom there is an existing dispute regarding the payment of a previous order and after having send a formal letter, or in case of Orders that are incomplete, incorrect or if the products are unavailable as well as in case of obvious error on the price of the Products. In these cases, TWINSET FRANCE will inform you by email that the contract has not been completed and, if applicable, reimburse the price within forty-eight hours (48) of this notification.


3. Stated prices



1 - All stated prices of Products displayed and indicated on the Digital Store are in Euros and are inclusive of VAT and any other tax that may be applicable in connection with the Order.

2 - The cost of shipping, transport, or other applicable additional costs, will be clearly indicated and displayed before completion of the Order.

3 - The ordered Products are invoiced at the price stated on the Digital Store at the time of the Order by the Client. The Client has to check the price of the Products before ordering. Any obvious price error that Client is reasonably able to identify as such, stated on the Digital Store, compared to the commonly known price of the selected Product, entitles TWINSET FRANCE not to proceed with the sale of the Product. A refund will be given to the value of the purchase price paid with no entitlement to oppose this.

4. Delivery methods



The delivery of products is carried out exclusively within the territory of Principality, without prejudice to the possibility for a non-Monegasque Client or foreign Customer to place an Order and to choose, for the delivery, an address located within the Principality of Monaco territory.

Shipping is free on all orders in Standard service. Shipping in Express service will cost 10 Euros. Orders are processed from Monday to Friday. Once the order is placed, it will no longer be possible to change the shipping address.

Delivery delays depend on the delivery service you select:

  • Standard: it will be delivered between five and six business days from the day after your Order is confirmed.
  • Express: it will be delivered within two and three business days between the day after your Order is confirmed.


Before confirming your Order, you will be informed of the shipping costs for the shipment method you select in the Order summary displayed on the Digital Store. This amount will be payable by you in addition to the price, including taxes, of the Products ordered.

When the Order is entrusted to the courier, you will be sent an email with instructions to track your Order easily. If you are a TWINSET FRANCE registered client, you can also monitor the process of the shipment in "My Orders" section, clicking on “Details” and then following "Follow the order". You can also track your Order by clicking on "Check my order": this link is at the bottom of every page of the Digital Store.

In the event that the order is not delivered or is delivered late, you can file a contact the Customer Care by writing to customer.care@twinset.com.


5. Payment methods



1 - Payment is due immediately upon confirmation of your the Order. Credit cards and Paypal are the only methods accepted for payment on the Digital Store.

All Orders are payable in euros. We accept the following credit cards: MasterCard®, Maestro®, Visa®, Visa Electron®, American Express®, Postepay®.

Your Order will only be shipped once the payment method has been verified and authorization for payment of the Order has been given. All payments may be subject to random checks by the payment circuits: in case your payment should fall in this case, the Order would be temporarily suspended and it will not be possible for us to proceed to the shipment until the conclusion of the checks.

2 - In the case of payment by credit card, the payment procedure will take place via a secure connection directly connected to the relevant bank and operator of the online payment service, to which TWINSET FRANCE can not access. In particular, the financial information (for example, the credit/debit card number or the date of its expiry) will be forwarded, via encrypted protocol, to Banca Sella or to other banks, which provide the related remote electronic payment services, without any third party having access to it, in any way. Furthermore, such information will never be used and/or stored in any format (including electronic format) by TWINSET FRANCE. The validity of the card could be verified through a pre-authorisation payment. This authorisation is not charged to the Client . The charge on your credit card occurs at the time of shipment of the purchased product.

3 - You are solely responsible for the data entered and therefore guarantee to use only credit cards for which you he have legitimate use.

4 - If selecting to pay by PayPal method, you will be redirected to the www.paypal.com website where you will make the payment for the Products, according to the procedure established and regulated by PayPal, and the terms and conditions of PayPal. The data entered on the PayPal site will be processed directly by the latter and will not be transmitted or shared with TWINSET FRANCE. TWINSET FRANCE is therefore not in a position to know, to proceed and does not store in any way the data of the credit card connected to your PayPal account or the data of any other payment facility connected to that account. The total amount due will be debited from PayPal at the completion of the online Order. In the event of withrawal from the Order and in any other event of reimbursement, for whatever reason, the amount of the reimbursement in your favour will be credited to your PayPal account. The credit times on the payment linked to this account depend exclusively on PayPal and the banking system. Once a credit has been sent to your account, TWINSET FRANCE cannot be held responsible for any delays or omissions in the credit of the refund amount. For any question or request, you shall contact PayPal directly.


6. Liability


TWINSET FRANCE will not he held responsible the service interruptions due to force majeure events or an unpredictable and insurmountable act of a third party to the contract that prevent, in whole or in part, the execution of the Order within the agreed time frame.

7. Client’s obligations



1 - Please note that no commercial trading can take place on this site. Twinset reserves the right to refuse the order if it detects a non-private use of the purchase. It is not possible to request the issue of a tax invoice.

2 - It is strictly forbidden for minors (anyone under the age of 18) to place an Order on the Digital Store.

3 - The data entered during the Order must be exclusively personal and genuine data of the Client and not of third parties, or fantasy. TWINSET FRANCE reserves the right to prosecute any violation or abuse before the competent courts.


8. Right of withdrawal and refunds


1 - You can withdraw from the Order without any penalty and without specifying the reason during the withdrawal period and under the conditions described below.

2 – This period begins on the day you take delivery of your Order and expires fourteen (14) days later.

In order to exercise your right of withdrawal, you must notify TWINSET FRANCE of your decision to withdraw by means of an unambiguous statement (for example an email sent to the address customer.care@twinset.com), using the contact details of TWINSET FRANCE mentioned on the Digital Store and in the confirmation email of the Order. In order for the withdrawal period to be respected, you must send your notification concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

You can also send a return request directly from the Digital Store by clicking on the "Easy Return" icon and following the instructions provided on the Digital Store. An email acknowledging receipt of your withdrawal will be sent without delay.

3 - You must return the Products, deliver them to the third party authorised by TWINSET FRANCE without undue delay and in any case within 14 days from receiving the order. The return address is printed on the pre-paid label that you found inside the package.

4 - The shipping costs related to the return of the Products will be supported by TWINSET FRANCE if you use the pre-printed sticker included within the original package used for the delivery of the Product. This procedure allows TWINSET FRANCE to directly bear the costs of returning to the courier and to track the Order. If you the Client do not use the pre-printed sticker included within the original package and decide to use a different courier for the return of the Products, the shipping costs will be at your cost and you will not be reimbursed in case of loss of the Products or if they are damaged during transport. In this last case, and in case of partial loss of Products, TWINSET FRANCE will make legal reserves to the carrier and will inform you in order to make your rights known to the latter.

5 - After the return of the Products, TWINSET FRANCE will carry out checks on their compliance with the conditions and terms indicated in this article and check their condition. In case of depreciation of the value of the Products resulting from handling other than that necessary to ensure the nature, quality and functioning of the latter, the Client may be held liable.

6 - If the right of withdrawal is exercised following the procedures and terms indicated in this article, TWINSET FRANCE will refund any amounts already obtained for the sale of Products.

7 - Whatever payment method you have chosen, the refund will be activated by TWINSET FRANCE in the shortest possible time and within fourteen (14) days, starting from the day on which you notified TWINSET FRANCE of your his decision to withdraw from the contract. TWINSET FRANCE may withhold the refund until have received the Products or until you have demonstrated that you have returned the Products, depending on which situation occurs first.

8 - TWINSET FRANCE will reimburse you using the same payment method you used for the Order, even if you used a virtual/disposable credit card. TWINSET FRANCE, for security reasons, cannot refund on a credit card different from the one used for the Order, except in the case in which the credit card has expired. In this instance please send an email to customer.care@twinset.com to arrange the most appropriate repayment method.

9 - Potential delivery costs you've incurred when purchasing the item won't be refunded.

11. Applicable law and jurisdiction



1 - Any dispute concerning the application, execution, interpretation and violation of the contracts concluded through the Digital Store is subject to French law and in particular to the Consumer Code, Chapter I "Consumer rights in contracts" - so as amended by Legislative Decree 21 February 2014, n. 21 - with specific reference to the legislation on distance contracts and the legislative decree 9 April 2003 n. 70 on certain aspects concerning e-commerce. However, it is specified that this choice shall not have the result of depriving the EU consumer or the Principality of Monaco consumer who does not have his or her habitual residence in France of the protection afforded to him or her by provisions that cannot be derogated from by agreement by virtue of the law of the EU country in which he or she has his or her habitual residence.

2 - In the event of a dispute, the Parties shall endeavor to resolve it amicably. In this sense, you may address a written complaint by registered letter with acknowledgement of receipt to TWINSET FRANCE. In the absence of an amicable agreement or in the absence of a response from TWINSET FRANCE within a period of one (1) month as from the reception of his written complaint, you have the possibility of referring, free of charge, if a disagreement remains, to a mediator registered on the list of the mediators established by the Commission of evaluation and control of consumer mediation pursuant to article L.615-1 of the French Consumer Code. You remain free to accept or refuse recourse to mediation and, in the event of recourse to mediation, each party is free to accept or refuse the solution proposed by the mediator.

You can also submit any complaints on the dispute resolution platform put online by the European Commission: https://commission.europa.eu/index_en.

In the absence of an amicable agreement, of recourse to mediation or of acceptance by the parties of the solution proposed by the mediator, the dispute opposing a Client to TWINSET FRANCE may be brought before the competent courts.


12. Changes and updates



If any provision of the GCS is held to be invalid, void, or unenforceable for any reason whatsoever, this shall not affect the validity, effectiveness and enforceability of the remaining provisions.
